Reuse and Redistribution of Articles Published in PMC

The American Physiological Society (APS) has, through arrangements with funding agencies (Wellcome Trust, Howard Hughes Medical Institute, and others), agreed to deliver for authors the final files (hereafter referred to as “articles”) used to generate the definitive published journal article, to PubMed Central (PMC) or the PMC UK (“PMC UK”) mirror site for non-commercial purposes. 

Articles posted to PMC are protected by APS-held copyright and are posted to PMC by permission of APS. At the time of delivery to PMC by the APS, posted articles include all changes made during peer review, copyediting, and publishing. PMC and PMC UK host organizations are responsible for all links within the article and for incorporating any publisher-supplied amendments or retractions issued subsequently. Articles for which no open access fee has been paid will be made freely available on the APS journal site and in PMC 12 months after article issue publication. Articles for which an open access fee has been paid will be made freely available immediately on publication of the final published version on the APS journal site and will be delivered to PMC for posting in the month of final issue publication.

For non-commercial purposes users may access, download, copy, display, and redistribute articles as well as adapt, text and data mine content contained in articles, subject to the following conditions:

  • The authors’ moral right to the integrity of their work is not compromised.
  • Where content in the article is identified as belonging to a third party, it is the obligation of the user to ensure that any use complies with copyright policies of the third party owner.
  • If article content is copied, downloaded, or otherwise reused for non-commercial research and education purposes, a link to the appropriate bibliographic citation (authors, journal, article title, volume, issue, page numbers, Digital Object Identifier (DOI) and the link to the definitive published version on the APS journal site) should be maintained. Copyright notices and disclaimers should not be deleted.
  • If article content is re-used, adapted or translated, a link to the appropriate bibliographic citation (authors, journal, article title, volume, issue, page numbers, DOI) and a link to the definitive published version on the APS journal site must be provided. Copyright notices and disclaimers must not be deleted. The following statement must be prominently displayed on the user’s work: “This is an unofficial adaptation or translation of an article that appeared in a publication of the American Physiological Society. The American Physiological Society has not endorsed the content of this adaptation or translation, or the context of its use.”

Use of articles for commercial purposes is prohibited. Commercial purposes include:

  • Copying or downloading of articles, or linking to such postings, for further redistribution, sale or licensing, for a fee;
  • Copying, downloading or posting by a site or service that incorporates advertising with such content;
  • The inclusion or incorporation of article content in other works or services (other than normal quotations with an appropriate citation), including translations, that is then available for sale or licensing, for a fee.
  • Use of articles or article content (other than normal quotations with appropriate citation) by for-profit organizations for promotional purposes, whether for a fee or otherwise.
  • Use for the purposes of monetary reward by means of sale, resale, license, loan, transfer, or other form of commercial exploitation.

APS articles as maintained on the APS publishing platforms, represent the definitive articles of record. Articles posted to or displayed by institutional repositories or non-APS Web sites are without warranty from APS of any kind, either expressed or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall APS be liable for any loss or damage arising out of or in connection with the use or performance of information contained in Articles posted or displayed on institutional repositories or non-APS Web sites.

APS retains all rights to articles or their contents provided under the U.S. Copyright Act (17 U.S.C. § 101, et seq.), except as expressly licensed hereunder, and any use of articles or their contents in contravention of the rights of APS under the US Copyright Act, or as permitted hereunder, is expressly prohibited. The terms and conditions contained herein set forth the understanding of the parties and may not be modified without the express written consent of both parties.
